DISCLOSURE NOTICE UNDER THE PERSONAL DATA PROTECTION LAW
As Çamaşırhane Film Yapım A.Ş., we process your personal data with the utmost care and with the necessary security measures in accordance with Law No. 6698 on the Protection of Personal Data (KVKK). To prevent the unlawful processing of your personal data and to ensure the level of security required to store it safely, we take the relevant technical and administrative measures within the technological means available. In this context, we would like to inform you of how your data is processed, and with whom and in which situations it may be shared.
Data Controller
Under KVKK, the “Data Controller” is “Çamaşırhane Film Yapım A.Ş.”, and your personal data will be collected and may be processed within the scope described below.
- Legal Grounds for Processing Your Personal Data
Your personal data is processed for the purposes set out below and in line with the principles laid down by the Law, so that Çamaşırhane Film Yapım A.Ş. can provide its services and properly fulfil its rights and obligations under the law. Your personal data may be processed for as long as your relationship with our company continues and may be kept in both digital and physical form.
- Purposes of Processing Your Personal Data
Your collected personal data may be processed for:
- Fulfilling obligations arising from the Labour Law, the Social Security Law, the Occupational Health and Safety Law and other legislation with regard to personnel,
- Tracking personnel duties and personnel entries and exits,
- In film projects, establishing contractual relationships with the owners of works so that the works can be used within the project, tracking contract processes, fulfilling obligations arising from Law No. 5846 on Intellectual and Artistic Works (FSEK) and other legislation, and informing authorised third parties and legal entities that the financial rights have been acquired from the owners of the works,
- Establishing relationships with customers or suppliers (their officers and employees), carrying out communication activities, tracking contract processes, and fulfilling the legal, commercial and administrative obligations arising from the contracts concluded,
- Managing and carrying out finance and accounting operations,
- Following up and handling legal matters,
- Carrying out the work required by the relevant departments so that the commercial activities stated in the company's articles of association are performed in line with the legislation and company policies,
- Ensuring coordination and the exchange of information and documents between our company and third-party legal entities with which it has business relationships,
- Planning, auditing and carrying out information security processes,
- Recording internal internet access logs as required by Law No. 5651,
- Fulfilling the supervisory obligation under Labour and Social Security Law regarding the supplier company's employees assigned to sets by the supplier company,
- Ensuring the safety of life and property, as well as the legal, commercial and occupational health and safety, of the real and/or legal third-party persons, institutions and organisations related to our companies (employees, visitors, suppliers, customers, etc.), and the physical security and supervision of the locations used by our company,
- Responding to requests for information and documents from judicial bodies and/or administrative authorities,
- Providing information to authorised institutions and organisations due to legal obligations and/or carrying out audit-related activities and obligations.
In addition, in accordance with Turkish Code of Obligations No. 6098, Turkish Commercial Code No. 6102, Law No. 6502 on Consumer Protection, Law No. 6563 on the Regulation of Electronic Commerce and the secondary legislation relating to these laws, obligations arising from tax legislation, cases made mandatory by other competent public authorities and other relevant legislation, your personal data may be processed, transferred to the physical and/or electronic archives and IT systems of Çamaşırhane Film Yapım A.Ş., and kept in both digital and physical form.
- To Whom and for What Purpose Your Processed Personal Data May Be Transferred
Within the scope of KVKK and the relevant legislation, your personal data, processed for the purposes listed under the heading “Purposes of Processing Your Personal Data” of this “Disclosure Notice” and in accordance with the “General Principles” in Article 4, the “Conditions for Processing Personal Data” in Article 5 and the “Conditions for Processing Special Categories of Personal Data” in Article 6 of KVKK, may, where necessary for processing, be shared with and transferred to the third-party real and legal persons (suppliers)/subcontractors from which our company purchases goods/services under contract in order to carry out its services and activities, real and/or legal third-party persons, institutions and organisations with which the company cooperates in any field, public institutions or organisations and third-party legal entities authorised by law to request such data, and the members of the company's board of directors, within the framework of the personal data processing conditions and purposes set out in Articles 8 and 9 of KVKK.
- Method of Processing Personal Data
Our company informs data subjects about the methods of collecting personal data, the purposes of processing it, the processing procedures, for what purposes and to whom personal data may be transferred, and the rights of the data subject. Where the Law requires explicit consent, the explicit consent of data subjects is obtained after our disclosure obligation has been fulfilled.
- Your Rights as a Data Subject
Under the Law, you have the right to: learn whether your personal data is processed; request information if your personal data has been processed; learn the purpose of processing your personal data and whether it is used in line with that purpose; know the third parties in Turkey or abroad to whom your personal data is transferred; request the correction of your personal data if it has been processed incompletely or incorrectly; request the deletion or destruction of your personal data; request that the correction, deletion or destruction of your personal data be notified to the third parties to whom it has been transferred; object to a result against you arising from the analysis of your processed data exclusively through automated systems; and claim compensation for damages if you suffer damage due to the unlawful processing of your personal data.
Pursuant to paragraph 1 of Article 13 of KVKK, you may submit your request to exercise the rights above to our Company in writing or by other methods determined by the Personal Data Protection Board. As the Personal Data Protection Board has not currently determined any method, you must submit your application to our Company in writing in accordance with KVKK. The channels and procedures for submitting your written applications under Article 11 of KVKK are explained below.
To exercise the rights above, you may deliver your request, signed with a wet signature and containing information identifying you and your explanations regarding the right under Article 11 of KVKK that you wish to exercise, in person together with documents proving your identity to Levent Mahallesi, Krizantem Sokak No:17, Beşiktaş, Istanbul, or send it through a notary public or by the other methods specified in KVKK.
Your requests submitted to Çamaşırhane Film Yapım A.Ş. will be answered in writing or electronically as soon as possible depending on the nature of the request and within thirty days at the latest, in return for the processing fee determined in Article 7 of the Communiqué on the Procedures and Principles of Application to the Data Controller.
Changes
Our Company reserves the right to make changes to this disclosure notice due to possible changes under KVKK and methods to be determined by the Personal Data Protection Board.
